Home Sale Possibilities That Buyers and Sellers Need to Know Articles – ArticleTed

Contingency clauses or home sale contingencies are often included in real estate purchase offers or sales contracts. If this occurs, the real estate transaction is contingent or dependent on the sale of the buyer’s home. If the buyer’s home is sold at the agreed time, the contract will be executed, if not automatically terminated.

Contingencies: There are two types of contingencies, sales and settlement contingencies and settlement contingencies.

  • Sales and settlement contingencies: It depends on the property the buyer is selling and occupying the existing home. This is generally used when a buyer received a current home purchase offer and has not yet accepted it. Usually in these emergency situations, the seller has the freedom to market the home to other buyers. If the seller accepts another offer, he or she will provide an opportunity to remove the settlement or sale contingency within a specified time period usually 24 to 48 hours. If the buyer cannot cancel, the contract will be terminated and another seller may accept another offer. The money deposited will be returned to the buyer.

  • Settlement contingencies: Used if the buyer has a contract to sell the property and a completion date has been set. Until settlement or closing occurs, the property is not actually sold. If the sale fails for any reason, this protects the buyer. In most cases, for a certain period of time, this contract prohibits the seller from marketing or accepting other offers on the property. If the buyer’s house is not closed then the contract will be terminated, if it is closed then it is valid.

Consideration

  • For buyers: When purchasing a more expensive home, most buyers will have to sell the home. Home sale contingencies give buyers time to sell their existing home and settle down. This also helps buyers avoid holding two mortgages and two homes at once. Buyers can sell their house and immediately move to the next house because it is locked. Home sale contingencies can provide peace of mind for buyers but other costs in a home purchase cannot be avoided. Buyers must incur appraisal fees, bank fees, and home inspections, and these fees are non-refundable if the property does not sell on time and the deal falls through.

  • For sellers: There is no guarantee that the house will sell, so it is risky for the seller. Even though the seller has the opportunity to market the home and enter into contracts with other parties, the rental home may be less attractive to other parties. Before agreeing, investigate the buyer’s current home to determine – if the home is not on the market it means the buyer is only thinking about buying. If listed at the correct price, a comparison can be prepared by a real estate agent to ensure the home is priced to sell. If the house has been on the market for a long time, this indicates that the market is dry or the price is too high.

Details of any contingencies must be specified in the sales contract. Because this is legally binding. A review and understanding of the term home sales contingency is important. A real estate attorney or qualified real estate professional should be consulted if you have concerns or questions regarding home sale contingency clauses in real estate contracts.
